Biography / History

Donald F. Paine graduated from The University of Tennessee in 1963 (B.A.,M.A.,LL.B.). Thereafter he served three years in the Army. He was the original author of Tennessee Law of Evidence, and he writes a monthly column for the Tennessee Bar Journal. Mr. Paine lectures for the Tennessee Law Institute, BAR/BRI Bar Review, The Tennessee Judicial Conference, and The University of Tennessee College of Law. He is Reporter to the Supreme Court Advisory Commission on Rules of Practice and Procedure. In 1983 he was President of the Knoxville Bar Association and in 1986-87 President of the Tennessee Bar Association. Mr. Paine was elected to membership in the American Law Institute and the American College of Trial Lawyers.


Collection Scope and Content Note

This collection consists of records of historical trials from Tennessee (including transcripts, newspaper clippings, photographs, audio recordings, VHS tapes, etc.) and materials from seminars for which Paine presented. The material has been divided into series according to the trials in which Paine studied for those presentations. Each series begins with official documentation of the case, which includes transcripts of proceedings and evidence which can be found in the folders labeled as binders. For example, Box 1, Folder 1, labeled State of Tennessee v. John A. Brown, Jr.: Binder 1, is that trial's evidence and defendan't bill of exception. For each trial, these legal transcripts are followed by Paine's supporting research for the case study. The series are in chronological order according to the crime committed.

The first series covers State of Tennessee v. John A. Brown, which is commonly known as the "Stringbean Murder Case." Stringbean, also known as David Akeman, was a well-known Country musician and a part of the television program Hee-Haw. Stringbean and his wife Estelle were murdered in Nashville in 1973.

Series II is the case study of two different trials based on the same crimes--The Douglas MacArthur Forbes Trials, and the Jerry Williams Trials. Forbes was convicted of a series of rapes in and around Johnson City, Tennessee in 1976. Five years later, District Attorney May writes a letter, found in Box 3 Folder 25, that explains Jerry Williams had confessed to the crimes, and Forbes was the victim of mistaken identity. There are several eyewitness identification articles and case study information included in this series.

Series III consists of the "Rocky-Top Murders" which occurred in 1986 in Gatlinburg, Tennessee. Please be cautioned that Box 5 Folder 25 consists of graphic crime scene photographs. "Tattoo Eddie" Harris was the main focus of this trial, though there are two others, Pelley and Demodica, who were also involved. This case was a turning point in Tennessee law, because it questioned whether a person with a low IQ could be sentenced to death.

The fourth and final series, Series IV, was a case study entitled "Sex in the Choir Loft" by Paine. A case revolving around a love triangle in Knoxville, Tennessee, Michael Frazier attempted to murder his lover's husband while he slept. The lovers knew each other from working at church, hence the title, and the evidence reveals the Knoxville story that made its way to People magazine, found in Box 6 Folder 47.
